INDICTMENT ISSUED FOR CRIMINAL OFFENCE OF ILLICIT TRADE IN EXCISE PRODUCTS

This accused person is charged with illegally procuring a large quantity of cigarettes, which were not marked with control and tax stamps in the manner prescribed by the tax legislation of Bosnia and Herzegovina, with the intention of putting those cigarettes on the illegal market.
As alleged in the Indictment, after the accused had previously procured the cigarettes from a person known to him, authorized officials of the Republika Srpska Ministry of the Interior conducted a regular inspection of a passenger motor vehicle in the evening of 26 September 2019, in the area of Banja Luka, and inside the vehicle they found and temporarily seized a large quantity of various types of cigarettes without excise stamps and with excise stamps of the Republic of Montenegro, which cigarettes had been illegally procured on the black market and were intended for further sale in order to obtain unlawful material gain.
This accused person is charged with the commission of the criminal offence of Illicit Trade in Excise Products, referred to in Article 210a, Paragraph 1, in conjunction with Article 26 of the Criminal Code of Bosnia and Herzegovina.
The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
