CUSTODY PROPOSED FOR FOREIGN CITIZEN SUSPECTED OF SMUGGLING OF MIGRANTS

Custody has been requested in relation to the suspect Anil Ahmad (1999), an Afghan citizen, due to the risk of the suspect’s flight.

Having questioned the suspect, the Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina in charge of this case has put forward a motion with the Court of Bosnia and Herzegovina, seeking the measure of custody to be ordered in relation to the following suspect:

-          Anil Ahmad, born in 1999 in Logar, Afghanistan, a citizen of Afghanistan.

This suspect is subject to investigation by the Prosecutor’s Office of Bosnia and Herzegovina, as he is suspected of smuggling ten (10) migrants, citizens of Afghanistan, across the river border on the Drina River, from Serbia to Bosnia and Herzegovina, all for the purpose of acquiring unlawful material gain.

The smuggled migrants did not have valid documents, nor did they meet the conditions for a legal entry and stay in Bosnia and Herzegovina. The said actions are in contravention of Article 6 of the Protocol against the Smuggling of Migrants by Land, Sea and Air, Supplementing the United Nations Convention against Transnational Organized Crime.

The said smuggling was carried out by boat, which endangered the lives and safety of the smuggled persons, including a minor child.

The measure of custody has been proposed for reasons set forth in Article 132, paragraph 1, item a) of the Criminal Procedure Code of Bosnia and Herzegovina, namely, due to the risk of the suspect’s flight, in view of the fact that the suspect would become inaccessible to the judicial authorities of our country if he left the country.

The Motion has been forwarded to the Court of Bosnia and Herzegovina.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
