EXTENSION OF CUSTODY PROPOSED FOR PERSONS SUSPECTED OF SMUGGLING LARGE QUANTITIES OF SKUNK MARIJUANA NARCOTIC DRUG WITHIN CASE CODENAMED “SKY”

03.04.2020. 14:17
Extension of custody has been proposed due to the risk of the suspects’ flight and the danger that, if at large, they might hinder investigation, conceal evidence and influence witnesses or accomplices, or commit a new criminal offence or complete the criminal offence.
  • EXTENSION OF CUSTODY PROPOSED FOR PERSONS SUSPECTED OF SMUGGLING LARGE QUANTITIES OF SKUNK MARIJUANA NARCOTIC DRUG WITHIN CASE CODENAMED “SKY”

As part of the case codenamed “Sky”, which relates to an international operation directed at combatting the smuggling of large quantities of the skunk marijuana narcotic drug from the territory of Montenegro to Bosnia and Herzegovina, and further towards the territory of the Republic of Croatia and the European Union, the Prosecutor from the Special Department for Organized Crime, Economic Crime and Corruption in charge of this case has put forward a motion with the Court of Bosnia and Herzegovina seeking the extension of custody with respect to four suspects.

These suspects are under investigation by the Prosecutor’s Office of Bosnia and Herzegovina and they are charged with organizing, while operating as an organized criminal group, and carrying out several truck transports of the skunk marijuana narcotic drug from the territory of Albania through Montenegro to Bosnia and Herzegovina, and further towards Croatia and the EU countries, all for the purpose of acquiring unlawful material gain.

During the investigation, the Prosecutor’s Office of Bosnia and Herzegovina, together with its partner law enforcement agencies of Bosnia and Herzegovina and countries in the region, documented the transports of hundreds of kilograms of this narcotic drug and organized actions in which large quantities of the aforementioned narcotic drug were intercepted, found and seized.

The above-mentioned suspects are charged to have acquired unlawful material gain of at least BAM 2.5 million by the commission of these criminal offences.

Custody has been proposed for reasons as set forth in Article 132, paragraph 1, items a), b) and (c).

The suspects are under investigation due to the commission of the criminal offences of Organized Crime (Article 250) and Illicit Trafficking in Narcotic Drugs (Article 195) of the Criminal Code of Bosnia and Herzegovina.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
