MOTION TO EXTEND CUSTODY FOR TERRORISM SUSPECTS

 A prosecutor from the Terrorism Section requested the extension of custody for suspects Hamza Labidi (1998) and Emir Ališić (1970) for another two months.
  • MOTION TO EXTEND CUSTODY FOR TERRORISM SUSPECTS

 

The case Prosecutor from the Special Department for Organised Crime, Economic Crime and Corruption - Section for Terrorism has submitted to the Court of BiH a motion for extension of custody for the suspects Hamza Labidi born in 1998 in Zavidovići and Emir Ališić, aka “Abu Talha” born in 1970 in Sanski Most.

 

The extension of custody was requested for the reasons described in Article 132 (1) (a), (b), (c) and (d) of the CPC of BiH, namely because of the risk of flight, because of the risk that, if at large, they could interfere with the investigation, conceal evidence and exert influence on witnesses or accomplices, and that they might commit a new criminal offence or complete the attempted one, as well as because of other extraordinary circumstances of committing the criminal offences, where their release would cause fear and anxiety to the public and citizens.

 

The aforementioned suspects are under investigation by the Prosecutor’s Office of BiH and they are suspected of having committed the criminal offence of Organising Terrorist Groups under Article 202d (2) in conjunction with the criminal offence of terrorism referred to in Article 201 of the Criminal Code of BiH (Ališić) and the Illegal Establishment and Joining Foreign Paramilitary or Parapolice Formations referred to in Article 162b of the CC BiH (Labidi).

 

The Prosecutor’s Office of BiH is conducting an intensive investigation against the suspects with a view to filing an indictment against them in the forthcoming period.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
