ACCUSED OF ILLICIT TRAFFICKING IN NARCOTIC DRUGS ENTERED GUILTY PLEA AGREEMENT
25.07.2019. 08:04The accused Namik Hasičević, born in 1953 in Brčko, charged with the criminal offence of Illicit Trafficking in Narcotic Drugs in violation of Article 195 of the Criminal Code of BiH, in the presence of his defence counsel, fully pleaded guilty to the criminal offence for which he was charged and signed a guilty plea agreement.
The accused admitted that in the course of 2018 he took part in the smuggling of approximately 500 grams of the mixture of the narcotic drug - heroin, as well as in the smuggling of 5 grams of the narcotic drug - marijuana, which were found on him and forfeited when he was deprived of liberty.
Pursuant to the Agreement, it is proposed that a three-year prison sentence (36 months) be imposed on him and that unlawful material gain in the amount of €11,000 acquired through sale of narcotic drugs be forfeited, as well as the items used in the commission of the criminal offence.
The proposed sentence is in line with the role and responsibility of the accused in the commission of the criminal offence.
The guilty plea agreement was forwarded to the Court of BiH for decision making.
If the Court of BiH adopts the guilty plea agreement, the case will be fully completed and the accused will waive his right to trial and the right to appeal the judgment rendered by the Court on the basis of the agreement.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
