CUSTODY PROPOSED AGAINST THREE SUSPECTS OF ORGANIZED SMUGGLING OF MIGRANTS

These suspects are subject to investigation by the Prosecutor’s Office of Bosnia and Herzegovina, since they are suspected, as members of an organized criminal group, to have smuggled migrants from the territory of the Middle East and through the territory of Bosnia and Herzegovina, whereby they acquired unlawful material gain.
The measure of custody has been proposed for the reasons set forth in Article 132 of the Criminal Procedure Code of Bosnia and Herzegovina, namely, due to the risk of flight of the first suspect, and the danger that, if at large, all of the aforementioned suspects might hinder the inquiry, conceal evidence and influence witnesses or accessories, as well as due to the danger that they might repeat the criminal offence or complete the criminal offence.
These suspects are charged with the commission of the criminal offence of Organizing a Group or Association for the Purpose of Perpetrating the Criminal Offence of Smuggling of Migrants, as referred to in Article 189a, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina (suspect Mirković) and Paragraph 2 (suspects Simić and Vićanović), all in conjunction with the criminal offence of Smuggling of Persons, as referred to in Article 189, Paragraphs 1 and 2 of the Criminal Code of Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
