PERSON ACCUSED OF SMUGGLING OF ILLEGAL MIGRANTS ENTERS INTO PLEA AGREEMENT ADMITTING HIS GUILT
22.03.2019. 15:54The accused Šćepan Dabović, born in 1955 in Nikšić, a citizen of Montenegro, has admitted his guilt in the presence of his attorney and signed a Plea Agreement for the commission of the criminal offence of Smuggling of Persons, as referred to in Article 189 of the Criminal Code of Bosnia and Herzegovina.
The accused has admitted that, on 11 March 2017, for the purpose of acquiring unlawful material gain, he transported in a motor vehicle eight (8) persons from the territory of Kosovo who did not have valid documents required to enter Bosnia and Herzegovina and who had previously illegally entered Bosnia and Herzegovina from the territory of Montenegro, in which crime he was detected in the area of Trebinje and prevented from committing it by police officers.
Pursuant to the Plea Agreement, the pronouncement of the sentence of imprisonment for a term of one (1) year has been proposed against the accused, as well as the fine in the amount of BAM 1,000, along with the extended confiscation of proceeds of crime in various currencies, in the total amount of around BAM 2,000.
The proposed sentence is in accordance with the role and responsibility of the accused and the gravity of the committed criminal offence.
By virtue of signing this Plea Agreement, the accused has waived his right to a trial and the right to appeal to the judgment pronounced against him by the Court of Bosnia and Herzegovina on the basis of this Plea Agreement.
The Plea Agreement has been forwarded to the Court of Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
