INDICTMENT ISSUED FOR SMUGGLING OF PERSONS

Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following person:
  • INDICTMENT ISSUED FOR SMUGGLING OF PERSONS

- HAMED RAYGAN, born in 1978 in Vashemiran, a citizen of the Islamic Republic of Iran, who is currently remanded in custody.

The accused is charged with enabling the illegal stay of eleven (11) migrants, nationals of Iran, Bangladesh and Afghanistan, by transporting them through the territory of Bosnia and Herzegovina, as well as with illegal transfer of migrants with the intention of their further transfer across the state border from Bosnia and Herzegovina to the Republic of Croatia and then to Italy as their ultimate destination, all with the intent of procuring unlawful material gain.

According to the allegations in the Indictment, during the month of October 2018, while acting in agreement with a person known to him from the Republic of Serbia who had previously illegally transferred a group of migrants across the state border from the Republic of Serbia to Bosnia and Herzegovina, the accused took over those migrants at a previously agreed location near Zvornik and drove them in the direction of Sarajevo, knowing that these migrants do not fulfil the conditions for a legal stay in Bosnia and Herzegovina.

For the above-described criminal action, the accused took a share from the agreed amount of money, with an agreement that the remainder of the money be paid to him upon their arrival in Sarajevo.

The accused was detected in the perpetration of the said criminal offence during the control conducted by the police officers of the Police Department in Kladanj.

The accused is charged with the commission of the criminal offence of Smuggling of Persons, as referred to in Article 189, paragraph 2, in conjunction with paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
