INDICTMENT ISSUED FOR WAR CRIMES COMMITTED IN FOČA
22.12.2017. 12:56Prosecutor of the Special Department for War Crimes within the Prosecutor’s Office of BiH issued an indictment against the following person:
- Milomir Davidović, born in 1955 in Foča, a citizen of Bosnia and Herzegovina
The suspect is charged with having acted contrary to the rules of International Humanitarian Law, during a widespread and systematic attack by the RS military, paramilitary and police forces aimed at the civilian Bosniak population in the Foča municipality area, in the period from 3 July to 7 July 1992 while acting in his capacity as a member of the RS Army.
According to the indictment several Bosniak women were captured in a village in the Foča municipality by RS military forces and placed in the Foča High School where they were illegally imprisoned during the mentioned period. The suspect is charged with having, on two occasions, taken three captured women out of the facility to rape them. The suspect raped and abused them together with other persons.
The criminal offenses described in the indictment are related to war crimes for which the indictments were issued by the ICTY Office of the Prosecutor.
The accused is charged with having committed the criminal offense of Crimes against Humanity under Article 172 (1) (g) in conjunction with Article 180 (1) of the CC BiH.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
