IN THE ORGANIZED CRIME CASE ALL OF THE ACCUSED CONCLUDED PLEA AGREEMENTS; SENTENCES RANGE TO A TOTAL OF 10 YEARS OF IMPRISONMENT AND CONFISCATION OF NARCOTIC DRUGS AND ILLEGALLY ACQUIRED PROPERTY.
20.11.2017. 08:21Having been confronted with the indictment and evidence, in the presence of a lawyer, all of the accused in the case v. Aleksa Krndija et al. have fully admitted guilt for the criminal offenses they are charged with.
The accused persons in the case codenamed ‘Repeated offender’ are charged with having, during 2016 and 2017, as an organized criminal group led by the primary accused, Aleksa Krndija, committed criminal offences to obtain, divide, traffic and sell Marijuana, Heroin and Cocaine at illegal narcotics market and with having, in concert with other persons, smuggled narcotic drugs from the territory of the Republic of Serbia to BiH and vice versa.
In accordance with the plea agreements the primary accused Aleksa Krndija (1962) was proposed a seven-year prison sentence as well as seizure of about 1.2 kilograms of narcotic drug Heroin, which is one of the largest seizures of narcotic drugs in the past period, seizure of money in the amount of about BAM 6,700 obtained through the sale of narcotic drugs, the amount of EUR 1,700 found during the search, as well as vehicle Mercedes, mobile phones and other items used for the commission of the criminal offense.
For the accused Vojislav Žugić (1981), a sentence of imprisonment of one year was proposed, as well as seizure of about 100 grams of narcotic drug marijuana, and an amount of BAM 2,500 which was obtained through the sale of narcotic drugs.
For the accused Srđan Krndija (1990), imprisonment sentence of 15 months was proposed.
For the accused Petar Krndija (1994) a sentence of imprisonment of one year was proposed.
Also, during the course of searches and arrests, about 2 kilograms of mixture, which is used to increase the mass of narcotic drugs in the illegal drug market, were found and seized.
By signing the agreement, all of the accused persons fully admitted committing the criminal offenses of Organized Crime (Article 250) and Illicit Trafficking in Narcotic Drugs (Article 195) of the CC BiH. The proposed sentences are in line with the role of the accused persons in commission of criminal offenses.
By virtue of signing the plea agreements the accused persons renounced the right to a trial and the right to appeal the judgment, which the Court of Bosnia and Herzegovina will pronounce on the basis of the agreement.
Given that the indictment included four accused persons, the acceptance of the agreements and the pronouncement of the sentences will result with case completion.
The agreements were forwarded to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
