INDICTMENT ISSUED AGAINST EMIR TUKULJ, EMPLOYEE OF CUSTOMS, FOR ABUSE OF OFFICE OR OFFICIAL AUTHORITY
11.10.2017. 15:03The indictment alleges that in the evening of 4 November 2016 at the border crossing Orašje Emir Tukulj has, while acting in his capacity as customs officer- associate, allowed a freight motor vehicle and a trailer with Austrian registration plates, which contained used technical and textile goods, to pass and failed to perform customs control and clearance of goods imported into the customs territory of Bosnia and Herzegovina, with the intent of acquiring benefit for another person.
The accused is charged with failure to collect customs duties and charges and to issue a receipt on payment of indirect taxes on the total amount of the estimated value of goods i.e. BAM 5,958.00, thereby causing damages to the BiH budget in the amount of BAM 1,598.15.
The accused is charged with: failure to execute his official duty, acquiring benefit to another person and causing damage to another person thus committing the criminal offense of Abuse of Office or Official Duty referred to in Article 220 (1) of the CC BiH.
The indictment was forwarded to the Court of BiH for confirmation.
