BIH PROSECUTOR’S OFFICE TO PUT FORWARD MOTION FOR CUSTODY AGAINST FOUR SUSPECTS IN ‘BOND’ ACTION

Custody will be requested due to the danger that, if at large, the suspects might hinder the inquiry, conceal evidence and influence witnesses or accessories.
  • BIH PROSECUTOR’S OFFICE TO PUT FORWARD MOTION FOR CUSTODY AGAINST FOUR SUSPECTS IN ‘BOND’ ACTION

After the questioning of the suspects, Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina in charge of this case will put forward a Motion with the Court of Bosnia and Herzegovina, seeking the measure of custody to be ordered against the four suspects.

These suspects are under investigation due to the commission of the criminal offence of Organized Crime, as referred to in Article 250 of the Criminal Code of Bosnia and Herzegovina, and the criminal offence of Illicit Trade in Excise Products, as referred to in Article 210a of the Criminal Code of Bosnia and Herzegovina, and they are suspected to have committed unlawful actions in relation to the trade in larger quantities of cigarettes not marked with appropriate excise stamps, whereby they caused great damage to the budget of Bosnia and Herzegovina.   

Custody will be proposed for the reasons set forth in Article 132, item b) of the Criminal Procedure Code of Bosnia and Herzegovina, namely, due to the danger that, if at large, the suspects might hinder the inquiry, conceal evidence and influence witnesses or accessories.

The investigation in this case continues with the aim of issuing an Indictment against these suspects.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
