Persons accused of the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, paragraph 1 of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 29 of the same Code, have admitted their guilt and signed plea agreements with the Prosecutor from the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of Bosnia and Herzegovina, in the presence of their respective defence attorneys.  With the acceptance of these Plea Agreements, the case will be completed in its entirety.
  • PERSONS ACCUSED OF ILLICIT TRAFFICKING IN NARCOTIC DRUGS ENTER INTO PLEA AGREEMENTS ADMITTING THEIR GUILT, SENTENCES OF IMPRISONMENT PROPOSED

The accused Marko Jevrić (born in 1993) and Goran Banović (born in 1985), from Nikšić, Montenegro, citizens of Montenegro, who are currently remanded in custody, have entered into plea agreements admitting their guilt.

These accused persons have admitted to have committed, as co-perpetrators, international smuggling of a larger quantity of the Skunk Marijuana narcotic drug, for an agreed sum of money. They crossed the border from the Republic of Montenegro to Bosnia and Herzegovina illegally, on foot, thus avoiding the measures of border control, whereas their further intentions were detected and prevented by official persons of the Border Police of Bosnia and Herzegovina.

In accordance with the respective Plea Agreements, the Prosecutor’s Office of Bosnia and Herzegovina proposes the pronouncement of the sentence of imprisonment against these accused persons in the range between two years and two years and six months, as well as the security measure of forfeiture of items used in the perpetration of the criminal offence. Means used for the perpetration of these criminal offenses, mobile phones included, will be forfeited from the accused persons.

By virtue of signing the Plea Agreements, these accused persons confirm that they have entered their pleas of guilty voluntarily, consciously and with understanding, with no coercion or persuasion.

According to the respective Plea Agreements, these accused persons waive their right to a trial and the right to appeal to the criminal sanction pronounced against them by the Court of Bosnia and Herzegovina.

The respective Plea Agreements have been forwarded to the Court of Bosnia and Herzegovina.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
