INDICTMENT ISSUED AGAINST NASER ORIĆ (1967) AND SABAHUDIN MUHIĆ (1968)

These accused persons are charged with acting in contravention of the provisions of the international humanitarian law and Geneva Conventions, during the war in Bosnia and Herzegovina and the armed conflict between the Army of the Republic of Bosnia and Herzegovina and the Army of Republika Srpska, in the areas of Srebrenica and Bratunac, while they were in the capacities of a Commander and a member of the Army of the Republic of Bosnia and Herzegovina, respectively.
The Indictment alleges that these accused persons committed the killing of three (3) prisoners of Serb ethnicity, in 1992, in the places of Zalazje, Lolići and Kunjerac.
The aforementioned accused persons are charged with the commission of the criminal offense of War Crime against Prisoners of War, as referred to in Article 144 of the Criminal Code of the Socialist Federal Republic of Yugoslavia (SFRY).
The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
As part of the same criminal case, the Prosecutor’s Office of Bosnia and Herzegovina will send a Request to the Swiss Confederation seeking extradition of the suspect Elfeta Veseli, as she is suspected of the commission of the criminal offense of War Crime against Civilians, namely killing of an underage boy of Serb ethnicity in 1992.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
