MOTION FOR PRE-TRIAL CUSTODY AGAINST THE SUSPECT VAHID BAJREKTAREVIĆ PUT FORWARD

Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of Bosnia and Herzegovina has put forward a Motion with the Court of Bosnia and Herzegovina, proposing pre-trial custody against the suspect Vahid Bajrektarević, born on 18 September 1970 in Bužim, a citizen of Bosnia and Herzegovina, who is suspected of the criminal offense of War Crimes against Prisoners of War, as referred to in Article 175 of the Criminal Code of Bosnia and Herzegovina.
  • MOTION FOR PRE-TRIAL CUSTODY AGAINST THE SUSPECT VAHID BAJREKTAREVIĆ PUT FORWARD

Having been deprived of liberty, the suspect was handed over to the Prosecutor in charge of this case who questioned him in the capacity of a suspect and subsequently put forward a Motion for pre-trial custody for a duration of one (1) month, for reasons as stipulated by Article 132, Paragraph 1, items a) and b) of the Criminal Procedure Code of Bosnia and Herzegovina.

Among other things, the measure of custody has been proposed due to the circumstances indicating the risk of flight of the aforementioned suspect, as well as due to the grounded suspicion that the suspect, if at large, might endeavor to influence witnesses, accessories or accomplices in an attempt to hinder and prevent the conduct of criminal proceedings against him.

Vahid Bajrektarević is subject to investigation of the Prosecutor’s Office of Bosnia and Herzegovina and, as a member of the Fifth Corps of the Army of the Republic of Bosnia and Herzegovina, he is suspected of committing tortures, abuses and rapes of war prisoners – members of the then National Defense of the Autonomous Province of Western Bosnia, who were detained in the improvised prison in the Command of the 505th Brigade of the Army of the Republic of Bosnia and Herzegovina, in the then Radoč Motel in Bužim.

The aforementioned Motion for ordering pre-trial custody has been put forward with the Court of Bosnia and Herzegovina.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
