THE ACCUSED PERSONS FEĐA JAHURA AND ČEPO DANIJEL CONCLUDED PLEA AGREEMENTS. SANCTIONS PROPOSED ARE IMPRISONMENT AND MONETARY FINES

  • THE ACCUSED PERSONS FEĐA JAHURA AND ČEPO DANIJEL CONCLUDED PLEA AGREEMENTS.  SANCTIONS PROPOSED ARE IMPRISONMENT AND MONETARY FINES

The following persons entered into plea agreement with the Prosecutor of the Special Department for Organized Crime Economic Crime and Corruption within the Prosecutor’s Office of BiH:

- Čepo Danijel, born on June 27, 1989 in Mostar, residing in Grude, citizen of BiH and the Republic of Croatia, and

- Jahura Feđa, born on April 9, 1977 in Mostar, where he resides, with prior convictions, citizen of BiH,

The two are accused of having committed a continued criminal offense of Organizing a group or an association for the purpose of perpetration of the criminal offenses of Trafficking in Persons and Smuggling of Migrants under Article 189a as read with Article 54 of the CC BiH and in conjunction with the criminal offense of Trafficking in Persons under Article 189 of the same Code.

Pursuant to the agreement the Prosecutor and the Defense Attorney agree that the accused Danijel Čepo be rendered  a  suspended imprisonment sentence for a term of 2 (two) years by the Court of BiH stipulating that the sentence will not be executed providing that the accused does not commit another criminal offense within the next 5 (five) years and an additional sentence in the form of a monetary fine of BAM 10 000 (ten thousand Bosnian convertible marks); that the accused Jahura Feđa be rendered a  suspended imprisonment sentence for a term of 1 (one) year and 6 (six) months by the Court of BiH stipulating that the sentence will not be executed providing that the accused does not commit another criminal offense within the next 4 (four) years and an additional sentence in the form of a monetary fine of BAM 1.500  (one thousand , five hundred Bosnian convertible marks).

By virtue of signing the agreement the accused persons fully admitted committing the criminal offenses they were charged with by the indictment of the Prosecutor’s Office of BiH issued on March 21, 2014 that was confirmed in its entirety by the Preliminary Hearing Judge of the Court of BiH on April 28, 2014.

The proposed sentence is in line with the roles of the accused persons in commission of the criminal offenses listed in the indictment.

With this agreement the accused persons confirm that they are aware of the content of the indictment of the Prosecutor’s Office of BiH. They also confirm that the plea statements were given voluntarily, knowingly, with full understanding and undertake to pay the costs of the proceedings in the amount that will eventually be determined by the Court of BiH.

Pursuant to these agreements the accused have waived their right to a trial as well as their right to appeal the criminal sanction that shall be rendered to them by the Court of BiH.

The agreements were submitted to the Court of Bosnia and Herzegovina
