INDICTMENT ISSUED AGAINST ISMET KAČAPOR (1951) FOR CUSTOMS FRAUD. DAMAGES TO BIH BUDGET AMOUNT TO BAM 84,000
19.09.2014. 15:11The accused is charged with having made eight imports of goods from the Republic of Turkey through the border crossing "Vardište” located at Višegrad municipality while using a forged document - certificate of origin, during the period from September 21, to November 16, 2005 while acting in his capacity as the director and responsible person in the company “Orlje-Prom" LLC Srebrenik.
Based on the use of the said form, the import of goods originating from the Republic of Turkey was enabled under the reduced customs duties and other charges payable on imports.
The above benefits were provided in accordance with international free trade agreement between Bosnia and Herzegovina and the Republic of Turkey ("Official Gazette, International Treaties", No. 6.3), with the amount reduced for BAM 84,306.85 from the amount which should normally be charged and paid to the Indirect Taxation Authority, thus causing damages to BiH budget for that amount.
The accused is charged with having committed the criminal offense of Customs Fraud under Article 216, Paragraph 3, in conjunction with Paragraph 1 of the CC BiH.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
