INDICTMENT ISSUED AGAINST DRAGAN DELIĆ (1979) FOR IMPERMISSIBLE USE OF COPYRIGHTS

Prosecutor of the Department III of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against Dragan Delić, born on 29 December 1979 in Goražde, resident of Banja Luka, a citizen of Bosnia and Herzegovina.
The accused Dragan Delić is charged with unauthorized multiplying of forged image and sound carriers in his family house in Banja Luka, from September 2011 to 20 March 2013, and with distributing them impermissibly at the sales stand in a market in Banja Luka, without the authorization of the author or other holder of copyright, which is in violation of Article 21 and Article 22 of the Law on Copyright and Related Rights (‘Official Gazette of Bosnia and Herzegovina’, issue no. 63/10).
The accused Dragan Delić is charged with multiplying and distributing the work of an author, without the authorization of the author or other holder of copyright, whereby he committed the criminal offense of Impermissible Use of Copyrights, as referred to in Article 243, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.
The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
