INDICTMENT ISSUED AGAINST THREE PERSONS FOR THE CRIMINAL OFFENSE OF VOTING FRAUD UNDER ARTICLE 152 OF THE CRIMINAL CODE OF BOSNIA AND HERZEGOVINA
14.05.2014. 15:35The Indictment has been issued against the following persons:
- Dragoljub Milović aka Dragan aka Šurda, born on 19 February 1971 in Goražde, resident of Goražde,
- Dragan Šekarić aka Pive, born on 04 November 1969 in Goražde, resident of Sarajevo; there are another proceedings ongoing before the Court of Bosnia and Herzegovina,
- Branko Pereula, born on 16 November 1973 in Foča, resident of Belgrade and Goražde.
These accused persons are charged with committing the criminal offense of Voting Fraud during the summer of 2010, in previous agreement and in relation to the general elections called for the month of October of that year, with the intention of fraudulently securing the necessary number of votes for Daliborka Milović, a wife to the accused Dragoljub Milović, and Branko Pereula to take positions of delegates at the Cantonal Assembly of the Bosnia- Podrinje Canton, them being the candidates of the Narodna Stranka Radom za Boljitak (NSRzB) /People’s Party of Work for Progress/.
They are charged with taking personal data from a larger number of citizens from the region of Goražde in a fraudulent manner, and registering them, again fraudulently and without those citizens’ knowledge, to vote by mail from addresses in the Republic of Serbia and the Republic of Montenegro, all under the pretext of registering voters and making the list of persons who will be engaged as observers, or of giving the possibility to vote before the elections in exchange for the sums of BAM 20-30, whereupon they submitted to the Central Election Commission votes of these persons by mail and thus influenced the election of Daliborka Milović to the position of a delegate of the People’s Party of Work for Progress at the Assembly of the Bosnia- Podrinje Canton in Goražde.
These accused persons are charged with the commission of the criminal offense of Voting Fraud, as referred to in Article 152 of the Criminal Code of Bosnia and Herzegovina, as read with Article 29 of the Criminal Code of Bosnia and Herzegovina.
The Indictment, its extensive evidentiary material and a proposal for hearing twenty (20) Prosecution witnesses, have been forwarded to the Court of Bosnia and Herzegovina for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
