THE ACCUSED DARKO GUROVIĆ ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT
07.05.2014. 15:04The accused Darko Gurović, born on 21 April 1972 in Trebinje, where he also resides, with prior convictions, employed at the Trebinje Public Security Center, a citizen of Bosnia and Herzegovina, has entered into a Plea Agreement admitting guilt for the criminal offenses he is charged with and he has concluded a Plea Agreement with a Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of Bosnia and Herzegovina.
By virtue of signing the Plea Agreement, the accused has fully admitted the commission of the criminal offenses he is charged with by the Indictment of the Prosecutor’s Office of Bosnia and Herzegovina dated 03 December 2013. The proposed sentence is consistent with the role of the accused in the commission of these criminal offenses.
The accused, as an employee of the Trebinje Public Security Center, is charged with becoming a member of the organized criminal group in the period from November 2009 to May 2010, which was involved in the commission of the criminal offenses related to the unauthorized international purchase and sale, shipment, mediation in, and delivery of Heroin and Marijuana narcotic drugs.
This accused person is currently serving his sentence for another criminal offense.
Pursuant to this Plea Agreement, the Prosecutor proposes to the Court of Bosnia and Herzegovina to impose a single compound sentence of imprisonment for a term of one (1) year and six (6) months on this accused person, as well as that, in the sense of Article 74 of the Criminal Code of Bosnia and Herzegovina, objects used or destined for use in the perpetration of this criminal offense, including mobile telephones, be forfeited from the accused.
The time which the accused spent in pre-trial custody will be credited towards the imposed sentence of imprisonment.
With this Plea Agreement, this accused person confirms to be familiar with the content of the Indictment of the Prosecutor’s Office of Bosnia and Herzegovina. At the same time, he confirms to have entered his plea of guilty voluntarily, consciously and with understanding, without any coercion or persuasion.
Moreover, by signing this Plea Agreement, the accused Gurović agrees to testify on all the facts known to him in this criminal case and on all the perpetrators or members of the group for organized crime known to him, as well as on the criminal offenses in the perpetration of which he himself may have participated.
With this Plea Agreement, this accused person waives his right to a trial and right to appeal to the criminal sanction imposed upon him by the Court of Bosnia and Herzegovina.
The Plea Agreement has been forwarded to the Court of Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
