INDICTMENT ISSUED AGAINST TWO PERSONS FOR WAR CRIMES COMMITTED IN KOTOR VAROŠ
30.04.2014. 14:44The Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against the following persons:
- Bosiljko Marković, born on October 14, 1965 in Banja Luka, residing in Laktaši; and
- Ostoja Marković aka. Čole, born on April 26, 1965 in Kotor Varoš, where he resides.
The accused are charged with having, during the armed conflict in Bosnia and Herzegovina as members of Kotor Varoš Brigade, acted contrary to the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War.
They are charged with having driven a van into Orahova in the evening of June 28, 1992 after which they entered a house and took away an underage fourteen-year old female, in the presence of her parents and family members, under the pretext that they are taking her to an exchange.
Following the event the two have alternately and repeatedly, under the threat of a knife and firearm, raped and sexually assaulted the underage victim for about three hours.
The accused are charged with having violated the rules of international law in time of war and armed conflict, and with having compelled a person to submit by force or threat of force to sexual intercourse - rape, thereby committing the criminal offense of War Crimes against Civilians under Article 173, Paragraph 1, Subparagraph e) of the Criminal Code of Bosnia and Herzegovina.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
