THE ACCUSED DENIS HODŽIĆ ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Denis Hodžić has entered into a Plea Agreement admitting guilt for the committed criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 26 and Article 29 of the same Code and the criminal offense of Impersonation, as referred to in Article 396, Paragraph 1 of the Criminal Code of Republika Srpska.
  • THE ACCUSED DENIS HODŽIĆ ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Denis Hodžić has entered into a Plea Agreement admitting guilt for the criminal offenses he is charged with and he has concluded a Plea Agreement with a Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH.

By virtue of signing the Plea Agreement, the accused Hodžić has fully admitted committing the criminal offenses he is charged with by the Indictment of the Prosecutor’s Office of BiH dated 25 December 2013.

Pursuant to this Plea Agreement, the Prosecutor proposes to the Court of Bosnia and Herzegovina to impose a compound punishment of imprisonment for a term of one (1) year and eight (8) months on the aforementioned accused.

As particularly mitigating circumstances in determining the aforementioned sentence of imprisonment, the Prosecutor has taken into account the conduct of the accused throughout the proceedings and his unconditional confession, as well as his family circumstances, the fact that he is married and father of three underage children, two of whom are children with special needs, as well as the fact that he has no prior convictions. 

The proposed sentence is consistent with the role of the accused in the commission of the criminal offenses described in the Indictment of the Prosecutor’s Office of BiH

dated 25 December 2013.  

With this Plea Agreement, this accused person confirms to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH. At the same time, he confirms to have entered his plea of guilty voluntarily, consciously and with understanding of legal consequences, and he takes upon himself an obligation to bear the expenses of the criminal proceedings that will be determined by the Court of Bosnia and Herzegovina, depending on the complexity of the proceedings.

By signing this Plea Agreement, this accused person waives his right to a trial and right to appeal to a criminal sanction imposed upon him by the Court of Bosnia and Herzegovina.

The Plea Agreement has been forwarded to the Court of Bosnia and Herzegovina.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
