SIX PERSONS ACCUSED OF SMUGGLING OF GOODS ENTERED INTO PLEA AGREEMENTS ADMITTING GUILT. ALONG WITH PRISON SENTENCES, THESE PLEA AGREEMENTS STIPULATE CONFISCATION OF ILLEGAL PROPERTY GAIN IN THE AMOUNT OF BAM 66,000 WHICH WILL BE RETUNED TO THE BUDGET
13.03.2014. 15:09The Plea Agreements admitting guilt were concluded with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH by the following accused persons:
1. Lazar Bajović, born on 04 June 1985 in Bileća where he also resides, citizen of BiH. Pursuant to this Plea Agreement, the Prosecutor, the Defense and the accused person agree that the Court of BiH impose on the accused a sentence of imprisonment for a term of one (1) year and three (3) months. In the sense of Article 110 and Article 111 of the Criminal Code of BiH, the accused is obliged to pay the amount of BAM 10,000.00 which represents the illegally acquired property gain.
2. Milan Vujović aka Žule, born on 30 September 1967 in Bileća, resident of Nikšić Municipality in Montenegro, citizen of the Republic of Montenegro. Pursuant to this Plea Agreement, the Prosecutor, the Defense and the accused person agree that the Court of BiH impose on the accused a sentence of imprisonment for a term of one (1) year. In the sense of Article 110 and Article 111 of the Criminal Code of BiH, the accused is obliged to pay the amount of BAM 25,000.00 which represents the illegally acquired property gain.
3. Duško Vujović, born on 29 November 1973 in Trebinje, resident of Bileća, citizen of BiH. Pursuant to this Plea Agreement, the Prosecutor, the Defense and the accused person agree that the Court of BiH impose on the accused a suspended sentence of imprisonment for a term of two (2) years and at the same time determine that the sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of four (4) years. In the sense of Article 110 and Article 111 of the Criminal Code of BiH, the accused is obliged to pay the amount of BAM 20,000.00 which represents the illegally acquired property gain.
4. Slaviša Đurica, born on 03 March 1970 in Stolac, resident of Berkovići Municipality, citizen of BiH. Pursuant to this Plea Agreement, the Prosecutor, the Defense and the accused person agree that the Court of BiH impose on the accused a suspended sentence of imprisonment for a term of two (2) years and at the same time determine that the sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of two (2) years. In the sense of Article 110 and Article 111 of the Criminal Code of BiH, the accused is obliged to pay the amount of BAM 10,000.00 which represents the illegally acquired property gain.
5. Darko Vujović, born on 26 January 1977 in Trebinje, where he also resides, citizen of BiH. Pursuant to this Plea Agreement, the Prosecutor, the Defense and the accused person agree that the Court of BiH impose on the accused a suspended sentence of imprisonment for a term of one (1) year and at the same time determine that the sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of three (3) years. In the sense of Article 110 and Article 111 of the Criminal Code of BiH, the accused is obliged to pay the amount of BAM 500.00 which represents the illegally acquired property gain.
6. Miloš Ždrale, born on 20 March 1983 in Trebinje, resident of Bileća, citizen of BiH. Pursuant to this Plea Agreement, the Prosecutor, the Defense and the accused person agree that the Court of BiH impose on the accused a suspended sentence of imprisonment for a term of one (1) year and at the same time determine that the sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of three (3) years. In the sense of Article 110 and Article 111 of the Criminal Code of BiH, the accused is obliged to pay the amount of BAM 500.00 which represents the illegally acquired property gain.
By virtue of signing these Plea Agreements, all of the aforementioned accused persons fully admitted committing the criminal offense they were charged with by the Indictment of the Prosecutor’s Office of BiH issued on 22 April 2013.
The proposed sentences are consistent with the gravity of the criminal offense and the roles of the accused in the commission of this criminal offense.
With these Plea Agreements, the accused persons confirm to be aware of the content of the Indictment issued by the Prosecutor's Office of BiH. At the same time, they confirm to give their plea statements voluntarily, consciously and with understanding, without any coercion or persuasion, and they take upon themselves an obligation to cover the costs arising from these criminal proceedings, in the amount that will be determined by the Court of BiH and which depends on the complexity of the criminal proceedings.
By signing this Plea Agreement, the accused persons waive their right to a trial and the right to appeal to a criminal sanction imposed upon them by the Court of BiH.
The Plea Agreements were forwarded to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
