CUSTODY PROPOSED AGAINST THE THREE SUSPECTS DEPRIVED OF LIBERTY IN THE ‘SECURITY’ POLICE ACTION

Ferald Gučanin Gazibarić aka ‘Ferdo’, born on 05 June 1971 in Travnik, resident of Nova Bila, citizen of BiH and the Republic of Croatia,
-
Oliver Sivonjić aka ‘Oli’, born on 28 August 1980 in Travnik, resident of Nova Bila, citizen of BiH and the Republic of Croatia, and
-
Dalibor Ivančević, born on 05 August 1975 in Banjaluka, where he also resides, citizen of BiH.
The aforementioned suspects, for whom the custody has been requested, were deprived of liberty on 03 March 2014 by authorized police officers of the Police Department of FBiH who cooperated with their colleagues from the RS Ministry of the Interior, and they were subsequently handed over to the Prosecutor’s Office of BiH within the statutory time limit.
The Prosecutor’s Office of BiH resumes its investigation in this case in order to detect all the persons involved in unlawful activities and aggravated robberies. As part of this investigation, significant cooperation has been established with judicial and police authorities of the Republic of Austria.
Having questioned the suspects, the Prosecutor in charge of this case has put forward a Motion with the Court of BiH seeking custody for reasons stipulated in Article 132, Paragraph 1, Items (a), (b) and (c) of the Criminal Procedure Code of BiH.
The measure of custody has been proposed due to the risk of flight of the suspects, as well as due to the fear that the suspects, if at large, might hinder the criminal proceedings by influencing witnesses or accessories, but also due to the justified fear that the suspects, if at large, might repeat the same or similar criminal offense for which a prison sentence of ten (10) or more years may be pronounced.
The Motion for Custody has been forwarded to the Court of BiH, and the Prosecutor’s Office of BiH resumes its investigation in this case for the purpose of issuing an Indictment.
The Prosecutor's Office of BiH supports coordinated and joint police actions aimed against all forms of crime, for the purpose of detecting and prosecuting perpetrators of criminal offenses and creating a safer environment for all the citizens in our country.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
