THE ACCUSED NOVO ĐUKIĆ (1972) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT FOR TAX EVASION. CCA. BAM 12,000 OF UNLAWFUL PROPERTY GAIN WILL BE FORFEITED

The accused Novo Đukić, born on 13 August 1972 in Kotor Varoš, where he also resides, citizen of BiH, accused of the criminal offense of Tax Evasion or Fraud, as referred to in Article 210, paragraph 1 of the Criminal Code of BiH, has entered into a Plea Agreement with a Prosecutor of the Department III of the Prosecutor’s Office of BiH.

By virtue of signing this Plea Agreement, the accused person has fully admitted the commission of the criminal offense he is charged with by the Indictment of the Prosecutor’s Office of BiH dated 15 January 2014 and confirmed by the Court of BiH on 22 January 2014.  

In accordance with this Plea Agreement, both the Prosecutor and the accused person agree that the Court of BiH impose a suspended sentence of imprisonment  in the duration of three (3) months on the accused Novo Đukić and, at the same time, delay its execution for a period of one (1) year to two (2) years (probation time), and that a fine in the amount of BAM 2,000.00 be pronounced against him as an accessory punishment, as well as that the Court forfeits the amount of BAM 12,084.00 from the accused as the property gain acquired by the commission of the criminal offense, all in the sense of Article 396 of the CPC BiH.

In determining this punishment, the following facts have been taken into consideration: the accused has plead guilty to the criminal offense charged with by the Indictment; he has expressed his willingness to fully settle his tax obligations; more than three years have passed since the commission of the criminal offense in question; he is a father of two minor children whom he supports; he has no prior convictions; by signing this Plea Agreement, he has helped this case to be resolved in an expedited and economic manner and thus influenced the reduction of the costs of the criminal proceedings; there have been no aggravating circumstances on the side of the accused.

The proposed sentence is consistent with the role of the accused in the commission of the criminal offense.

With this Plea Agreement, this accused person confirms to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH. At the same time, he confirms to have entered his plea of guilty voluntarily, consciously and with understanding.

By signing this Plea Agreement, this accused person waives his right to a trial and right to appeal to a criminal sanction imposed upon him by the Court of BiH, and that he is aware that he may cover the expenses of the criminal proceedings.

The Plea Agreement has been forwarded to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
