TWO PERSONS ACCUSED OF ILLICIT INTERNATIONAL TRAFFICKING IN NARCOTIC DRUGS CONCLUDED PLEA AGREEMENTS

The following two persons accused of illicit international trafficking in narcotic drugs concluded plea agreements:
  • TWO PERSONS ACCUSED OF ILLICIT INTERNATIONAL TRAFFICKING IN NARCOTIC DRUGS CONCLUDED PLEA AGREEMENTS

1.   The accused BAGNA PASTORELLO Andrea – born on June 10, 1973 in Torino (Republic of Italy) where he resides, citizen of the Republic of Italy – expressed his guilt for the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the CC BiH and the criminal offense of Illegal Manufacturing and Trade in Weapons or Explosive Materials, under Article 399 of the Republika Srpska CC and entered into plea agreement with the Prosecutor of the Special Department for Organized crime Economic Crime and Corruption within the Prosecutor's Office of BiH. Pursuant to the agreement the Prosecutor agrees that the accused be rendered unconditional imprisonment sentence in duration one (1) year and three (3) months by the Court of BiH, as well as that security measure of forfeiture of items used in commission of the criminal offense i.e. one paper bag containing 4,869 grams of narcotics, one semi-automatic rifle, six 7,62 mm bullets for a semi-automatic rifle and the „BMW“ vehicle, be imposed.

2.   The accused AQUINO GERONIMO Evelin – born on June 19, 1980 in S.J. De Ocoa, (Dominican Republic), residing in Torino (Republic of Italy), citizen of the Dominica Republic - expressed her guilt for the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the CC BiH and entered into plea agreement with the Prosecutor of the Special Department for Organized crime Economic Crime and Corruption within the Prosecutor's Office of BiH. Pursuant to the agreement the Prosecutor agrees that the accused be rendered unconditional imprisonment sentence in duration one (1) year by the Court of BiH, as well as that security measure of forfeiture of items used in commission of the criminal offense i.e. one paper bag containing 4,869 grams of narcotics, be imposed.

By virtue of signing the agreement the accused persons fully admitted committing the criminal offenses they were charged with by the indictment of the Prosecutor’s Office of BiH issued on November 11, 2013. The proposed sentence is in line with the role of the accused persons in commission of the criminal offenses listed in the indictment of the Prosecutor's Office of BiH and all aggravating and mitigating circumstances surrounding them.

The accused persons are charged to have, together with other persons known to them and  in the intent to acquire unlawful gain, transported narcotic drug Cannabis Sativa L (Hashish), which was declared a narcotic drug by regulation and the trafficking of which is prohibited in BiH, from Italy to BiH in a motor vehicle with the aim to sell. During the search of the motor vehicle conducted on September 19, 2013 the authorized officers of the RS MoI found the concealed drug i.e. 4896 grams of Hashish. The indictment also alleges that the  accused BAGNA PASTORELLO Andrea illegally acquired and kept a semi-automatic rifle and six pieces of 7.62 mm caliber bullets, the acquisition and holding of which is prohibited for citizens,  in a house that he used in the Municipality of Ribnik. Weapon and ammunition were found during a search conducted on September 19, 2013.

With this agreement the accused persons confirm that they are aware of the content of the indictment of the Prosecutor’s Office of BiH. They also confirm that the plea statements were given voluntarily and knowingly with full understanding of their legal consequences in accordance with Article 231 of the Criminal Procedure Code of Bosnia and Herzegovina.

By virtue of signing the plea agreement the accused persons pledge to testify for the Prosecution against the other suspects in this investigation or any subsequent indictments before the Court of BiH, when summoned, as well as about other investigations handled by the Prosecutor's Office that they may have information about.

Pursuant to this agreement the accused have waived their right to a trial as well as their right to appeal the criminal sanction that shall be rendered to them by the Court of BiH.

The agreement was submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
