REACTION OF THE PROSECUTOR’S OFFICE OF BIH FOLLOWING THE ACTIVITIES OF THE SERBIAN JUDICIARY
30.01.2014. 15:32After the War Crimes Department of the High Court in Belgrade had initiated activities pertaining to issuing warrants for the citizens of Bosnia and Herzegovina on the basis of the criminal report of the Serbian Ministry of the Interior dating from 2011, the Prosecutor’s Office of BiH reacted promptly and had talks with the colleagues from the Office of the War Crimes Prosecutor of the Republic of Serbia to discuss the possibilities for an exchange of information and evidence in this case pursuant to the Protocol on Cooperation in Prosecution of Perpetrators of War Crimes, Crimes against Humanity and Genocide, in order to possibly form a case within the Prosecutor’s Office of BiH.
Such activities will not and cannot hamper the cooperation between the two respective Prosecutor’s Offices and their Protocol on Cooperation.
We would like to emphasize and clarify for the public that the aforementioned activities of the Court in Belgrade bear no relation whatsoever to the Prosecutor’s Office of BiH and the respective Protocol on Cooperation, and that the Prosecutor’s Office of BiH is not in any way taking part in the activities related to the issuance of these warrants.
*Note on the principle of presumption of innocence
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
