INDICTMENT ISSUED AGAINST GORAN VUJOVIĆ AND MIROSLAV DUKA
26.12.2013. 15:40The Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against the following persons:
- Goran Vujović, born on May 4, 1959 in Preraca - Bileća municipality where he resides, citizen of BiH and
- Miroslav Duka, born on June 6, 1960 in Dolovi - Stolac municipality, residing in Trebinje, with prior convictions, citizen of BiH and the Republic of Serbia.
The aforementioned accused persons are charged to have, while acting in their capacity i.e. Goran Vujović as the Chief of PSS Bileća and Miroslav Duka as the militia commander in Bileća PS, in the period from the beginning of June until the end of December 1992, during the war in BiH and within a widespread and systematic attack of the military, police and paramilitary of the Serb Republic of Bosnia and Herzegovina- later known as Republika Srpska, that was directed against the civilian Bosniak and Croat population in the wider area of the municipality of Bileća, with knowledge of the attack and the fact that their actions form a part of the attack, knowingly and willingly participated in a joint criminal enterprise with the common goal of realization of strategic objectives in accordance with which they ordered and committed persecution of non-Serb civilians from Bileća municipality on ethnic and religious grounds and based on discriminatory intent.
Implementation of the strategic plan has, in addition to the persecution of the Bosniak and Croat population from the territory of the municipality Bileća, included unlawful incarceration in inhumane conditions, deportation, killings, torture, physical and psychological abuse, by way of coordinating with the Chiefs and commanders of the police, the Public Security Station Gacko and PSS Nevesinje involved planning, ordering and organizing the unlawful arrests of Bosniak and Croat civilians, after which they enabled and organized their incarceration in camp facilities, which were located in the building of PSS Bileća and Students Home in Bileća.
Actions of the suspects are closely associated with actions of their subordinates - members of the active and reserve-police Bileća, and the actions of members of the military or paramilitary groups.
The suspects knew of all these crimes, to which the non-Serb prisoners were exposed in the premises of PSS Bileća and Students Home in Bileća, and have fully supported and encouraged such crimes because they never tried to prevent or take action on investigating and punishing the perpetrators of these crimes; the suspect Miroslav Duka has also personally participated in the killings, physical and physical and psychological abuse and torture of the detained persons.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
