INDICTMENT ISSUED AGAINST LUKA MAJSTOROVIĆ (1964)
26.12.2013. 15:04The Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against Luka Majstorović, born on October 9, 1964 in Sarajevo, residing in Prebljezi - Srbac municipality, a citizen of Bosnia and Herzegovina.
The accused Luka Majstorović is suspected to have, during the war in Bosnia and Herzegovina and the armed conflict between the Army of the Serb Republic of Bosnia and Herzegovina - later the Republika Srpska Army and the Army of Bosnia and Herzegovina, violated provisions of Article 3 of the Geneva Convention relative to the Protection of Civilian Persons in Time of War of August 12, 1949, while acting in capacity of an investigator and the operative of the CID within the PSS Novo Sarajevo – Task force Kula.
The indictment alleges that in May 1992 in Kula correctional facility the accused physically abused, kicked and punched all over two Bosniak civilians while questioning them. As further alleged in the indictment, the accused has, also in May and in the premise of Kula correctional facility, physically abused, kicked and punched all over one Bosniak civilian together with another CID operative while questioning. The civilian has suffered serious injuries to the head and has experienced major fear.
The accused Luka Majstorović is charged with violating the rules of international law in time of war and armed conflict thus committing the criminal offense of War Crimes against Civilians under Article 173, Paragraph 1, Subparagraph c) of the Criminal Code of BiH in conjunction with Article 180, Paragraph 1 of the same Code.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
