MOTION FOR REMAND IN CUSTODY/ORDER OF PROHIBITING MEASURES FILED FOR PERSONS SUSPECTED OF WAR CRIMES IN KOTOŠ VAROŠ

The Prosecutor's Office of BiH filed a motion to the Court of BiH to remand two persons in custody and to order prohibiting measures for five persons suspected of committing the criminal offense of Crimes against Humanity under Article 172 of the CC BiH.

Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the persons with the following initials: S.T. and D.V. in custody.

The aforementioned persons were arrested by SIPA officers in the morning hours of December 3, 2013 and handed over to the Prosecutor's Office of BiH on the same day, where they were questioned as suspects by the Assigned Prosecutor.

Remand in custody was requested on grounds specified in Article 132, Paragraph 1, Subparagraphs a) and b) of the CPC BiH. Remand in custody was requested, inter alia, due to the risk of flight and the risk that if r4ealeased the suspects might interfere with the investigation, suppress evidence and exert influence on witnesses, accessories or accomplices.

Following the questioning the Assigned Prosecutor decided to file a motion to the Court of BiH to order prohibiting measures i.e. house arrest and travel ban, pursuant to Article 126b, Paragraph 1 of the CPC BiH, for the suspects D.B., D.M., R.K., R.Š. and I.K..

The motion for remand in custody/order of prohibiting measures was submitted to the Court of BiH and the Prosecutor’s Office of BiH continues its investigation in this matter.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
