MOTION FOR REMAND IN CUSTODY FILED FOR GORAN VUJOVIĆ (1959) AND MIROSLAV DUKA (1960)

05.12.2013. 15:12
Prosecutor of the Prosecutor's Office of BiH has filed a motion to the Court of BiH to remand the suspects Goran Vujović (1959) and Miroslav Duka (1960) in custody on grounds stipulated in Article 132, Paragraph 1, Subparagraphs b) and d) of the CPC BiH.

Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the suspects: Goran Vujović - born on May 4, 1959 in Bileća where he resides, citizen of BiH and Miroslav Duka - born on June 6, 1960 in Stolac municipality, residing in Trebinje, BiH citizen, in custody

The aforementioned suspects are under investigation by the Prosecutor's Office of BiH and are suspected to have participated in the persecution of non-Serbs in the area of Billeća municipality in 1992.The suspect Goran Vujović was the Chief of PSS Bileća at the time and Miroslav Duka was the militia commander of PSS Bileća.

They are, more specifically, suspected of unlawful confinement, deportation, murder, torture and physical and psychological abuse of Bosniaks and Croats in Bileća municipality in 1992.

The suspects Goran Vujović and Miroslav Duka are under investigation for the criminal offense of Crimes against Humanity under Article 172, Paragraph 1, Subparagraph h of the Criminal Code of BiH.

The prosecutor requested remand in custody due to belief that there are circumstances indicating the risk that, if released, these suspects might interfere with the investigation and influence witnesses or accomplices, as well as due to the fact that the suspects are under investigation for a serious crime that caused extremely serious consequences, hence their release could cause a disturbance of public order and distress citizens.

The Prosecutor's Office of BiH filed a motion to the Court of BiH, on the aforementioned grounds, to remand the suspects in custody for a period of 30 days.

The Court of BiH shall decide on the motion for remand in custody.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
