MOTION FOR REMAND IN CUSTODY AND FOR IMPOSURE OF PROHIBITING MEASURES FILED FOR PERSONS DEPRIVED OF LIBERTY IN THE OPERATION CODENAMED "POSKOK"
07.11.2013. 14:56Persons detained are suspected of cross-border smuggling of narcotics from the territory of the Republic of Albania and the Republic of Montenegro to Bosnia and Herzegovina. The Prosecutor's Office of BiH charges the suspects with involvement in the criminal offenses of Illicit Trafficking in Narcotic Drugs under Article 195 of the CC BiH and Organized Crime under Article 250 of the same Code.
Following the questioning of the suspects the Assigned Prosecutor requested remand in custody for the duration of one month for the following persons:
- M.B. (1976), a citizen of the Republic of Montenegro,
- Lj. R. (1977), a citizen of the Republic of Montenegro
- V.K. (1991), a citizen of Bosnia and Herzegovina.
Remand in custody was requested for suspects M.B. and R. Lj. on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a) and b) of the CPC BiH, and for the suspect V.K. on grounds stipulated in Article 132 Paragraph 1, Subparagraph b) of the CPC BiH. Remand in custody was, inter alia, requested due to risk of flight, as well as the risk that, if released, the suspects might interfere with the investigation, suppress evidence and seek to influence the witnesses, co-perpetrators or accessories.
Following the questioning the Assigned, Prosecutor requested that prohibiting measures be imposed on the following suspects:
- O.F. (1982), a citizen of Bosnia and Herzegovina
- M.M. (1979), a citizen of Bosnia and Herzegovina
- D.C. (1973), a citizen of Bosnia and Herzegovina, and
- V.H. (1970), a citizen of Bosnia and Herzegovina.
The Assigned Prosecutor decided to file a motion to the Court of BiH to order prohibiting measures of house arrest and travel ban, as well as temporary seizure of travel documents with the ban on issuing new documents and the ban on the use of the ID card for crossing the state border in accordance with Article 126, Paragraphs 1 and 2, as well as the prohibiting measures of ban on meeting with other suspects and the obligatory reporting to the relevant police station twice a week pursuant to Article 126a Paragraph 1, Subparagraphs c) and d) of the CPC BiH.
Motion for remand in custody and imposure of prohibiting measures was filed with the Court of BiH and the Prosecutor's Office continues the investigation in the aim to indict.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
