RUSMIR BUKVA (1990) CONCLUDED A PLEA AGREEMENT
05.11.2013. 15:17Pursuant to the Agreement, Prosecutor and the accused agree that the accused Rusmir Bukva be rendered an imprisonment sentence in duration of eight (8) months by the Court of BiH that shall not be executed providing that the accused does not commit another criminal offense within two years following the final verdict, as well as that he be fined with an amount of BAM 1000.
By virtue of signing the agreement the accused fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH of July 2, 2013 that was confirmed in its entirety by a Preliminary Hearing Judge of the Court of BiH on July 10, 2013.
The proposed sentence is in line with the role of the accused in commission of the criminal offense.
Pursuant to Article 205, Paragraph 5 of the CC BiH and in conjunction with Article 74 of the same Code the counterfeit banknotes i.e. one BAM 50 banknote and one BAM 100 banknote, shall be forfeited from the accused and destroyed.
With this agreement the accused confirms that he is aware of the content of the indictment of the Prosecutor's Office of BiH. He also confirms that the plea statement was given voluntarily, knowingly and with full understanding and that he understands that he could bear the costs of the criminal procedure.
Pursuant to this agreement the accused has waived his right to a trial and the right to appeal the criminal sanction that shall be rendered to him by the Court of BiH.
The agreement was submitted to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
