GOKMEN CINAR (1971) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The person accused of the criminal offense as referred to in Article 149, Paragraph 6 of the Industrial Property Law of BiH, as read with Paragraph 5 of the same Law, has entered into a Plea Agreement admitting guilt.

The Accused Gokmen Cinar, born on 01 March 1971 in Bogazliyan in the Republic of Turkey, resident of Srebrenik, citizen of the Republic of Turkey, has entered into a Plea Agreement with a Prosecutor of the Prosecutor’s Office of BiH, admitting guilt.

The Prosecutor has proposed that the Court of BiH sentence the Accused Gokmen Cinar to pay a fine in the amount of BAM 4,000.00 (four thousand convertible marks).

Pursuant to Article 69, item d) and Article 74 of the BiH CC, as well as Article 149, Paragraph 9 of the BiH Industrial Property Law, objects used for the commission of the criminal offense which were listed in the Indictment will be confiscated from the Accused Gokmen Cinar, a large quantity of counterfeit trademarks of famous brands and a number of clothing items being among them.

By signing the Plea Agreement admitting guilt, the Accused has fully admitted the commission of the criminal offense he is charged with by the Indictment of the Prosecutor’s Office of BiH dated 14 June 2013.

The proposed sentence is consistent with the role the Accused had in the commission of the criminal offense.

With this Plea Agreement, the accused person has confirmed to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH dated 14 June 2013. At the same time, he has confirmed to have entered his plea of guilty voluntarily, consciously and with understanding, and he has taken upon himself an obligation to bear the costs of the criminal proceedings in the amount that may be determined by the Court of BiH.

With this Plea Agreement, the Accused has waived his right to a trial and right to appeal to a criminal sanction imposed upon him by the Court of BiH pursuant to this Plea Agreement.   

The Plea Agreement has been forwarded to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
