PROSECUTOR’S OFFICE OF BIH WILL APPEAL THE DECISION OF THE COURT OF BIH NOT TO ORDER CUSTODY AGAINST THE SUSPECTS OF WAR CRIMES IN ROGATICA

Releasing suspects to conduct their defense has caused great anxiety among the victims’ population and it may have negative impact on the process of return, justice and reconciliation, in view of the fact that these suspects reside in an environment in which a larger number of returnees lives, including the families of victims of war crimes charged against these suspects.
The Prosecutor’s Office believes that releasing these suspects to conduct their freedom, with prohibiting measures imposed, may harm investigation in this case, especially so since the suspects know now that the Prosecutor’s Office disposes with a wide range of evidence.
Also, by lodging the Appeal, the Prosecutor’s Office of BiH expresses its position by which it refuses to bear any responsibility whatsoever in case some of the accused become unavailable to justice.
This Appeal to the Decision of the Court of BiH rendered in the case of Marković et al., reasoned in detail, will be forwarded to the Court today.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
