PARTIES ACCUSED WITHIN THE ORGANIZED CRIME AND TAX EVASION CASE CONCLUDED PLEA AGREEMENTS. THE AGREEMENTS INCLUDE TWO LEGAL PERSONS. AN AMOUNT OF 150,000 BAM OF ILL-GOTTEN GAIN WILL BE RECOVERED FOR THE BUDGET.

The accused persons: Maja Relja, Safet Čolaković, Edo Čolaković and legal persons „SAFETY & CO“ d.o.o. /LLC/ Mostar and „KING BH“ d.o.o. /LLC/ Mostar, concluded Agreements on Admission of Guilt for the criminal offense of Organized Crime under Article 250 in conjunction with the criminal offense of Tax Evasion or Fraud under Article 210 of the BiH CC and the criminal offense of Tax Evasion under Article 273 of the FBiH CC, all in conjunction with Article 31 of the BiH CC.

The following accused persons entered into plea agreements with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH:

-  Maja Relja, born on May 17, 1980 in Zenica, BiH citizen,

-  Safet Čolaković, born on January 18, 1958 in Čapljina, residing in Sarajevo, BiH citizen,

-  „SAFETY & CO“ d.o.o. Mostar – legal person registered to and represented by the owner Safet Čolaković,

-  Edo Čolaković, born on August 4, 1984 in Čapljina, residing in Sarajevo, BiH citizen, and

- „KING BH“ d.o.o. Mostar - legal person registered to and represented by the owner Edo Čolaković.

By virtue of signing the Plea Agreements, the accused persons fully admitted committing the criminal offenses they were charged with by the Indictment of the Prosecutor’s Office of BiH issued on May 7, 2012, which was confirmed in its entirety by a Preliminary Hearing Judge of the Court of BiH on May 15, 2012.

Pursuant to the Plea Agreement, the Prosecutor, the Defense Attorneys and the accused persons agree that the Court of BiH render a suspended sentence against the accused Maja Relja, Safet Čolaković and Edo Čolaković by imposing a compound punishment of imprisonment in the duration of two (2) years which will not be executed providing that these accused persons do not commit another criminal offense during the next four (4) years, as well as that the accused legal persons -„SAFETY & CO“ d.o.o. Mostar and „KING BH“ d.o.o. be rendered a criminal sanction of Dissolution of the Legal Person under Article 134 of the BiH CC.

Pursuant to Article 110 and Article 111 of the BiH CC, the accused person Edo Čolaković is obliged to pay the amount of BAM 39.821,80 and the accused Safet Čolaković is obliged to pay the amount of BAM 110.401,07, which represent the ill-gotten gain.

The proposed sentence is consistent with the role of the accused persons in the commission of the criminal offense within the scope of the Indictment filed against several persons.

By signing these Plea Agreements, the accused persons confirm that they are aware of the content of the Indictment issued by the BiH Prosecutor's Office and that they gave their plea statements voluntarily, consciously and with understanding and without any coercion or persuasion.

With this Plea Agreement, these accused persons waive their right to a trial and right to appeal to a criminal sanction imposed upon them by the Court of BiH on the basis of this Plea Agreement.  

The Plea Agreements were submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
