CUSTODY PROPOSED AGAINST EIGHT SUSPECTS

Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of BiH has put forward a Motion with the Court of BiH seeking custody against eight persons deprived of liberty by authorized officers of the State Investigation and Protection Agency –SIPA.

Motion for custody has been put forward with respect to the following suspects:

- Radomir Marković, born on 22 June 1954 in Rogatica,

- Mile Kušić, born on 07 January 1971 in Rogatica,

- Dragan Božović, born on 19 March 1968 in Rogatica,

- Saša Perković, born on 14 October 1971 in Rogatica,

- Radomir Gluhović, born on 07 January 1964 in Rogatica,

- Pero Radović, born on 16 May 1963 in Rogatica,

- Ilija Vukašinović, born on 14 September 1961 in Rogatica, and 

- Miloš Vukašinović, born on 01 March 1968 in Rogatica.

The aforementioned suspects are charged with the commission of the criminal offense of Crimes against Humanity, as referred to in Article 172, Paragraph 1, item h), as read with items a), d) and i), all in conjunction with Article 29 and Article 180, Paragraph 1, of the Criminal Code of Bosnia and Herzegovina.

Having questioned the suspects, the Prosecutor in charge of the case put forward a Motion with the Court of BiH seeking custody in the duration of thirty (30) days for reasons as stipulated in Article 132, Paragraph 1, item b), of the BiH CPC.  

Inter alia, the measure of custody has been proposed due to the risk that the suspects, if at large, might destroy, conceal, alter or falsify evidence or clues important to the criminal proceedings, as well as due to the justified fear that the suspects, if at large, might hinder the inquiry by influencing witnesses, accessories or accomplices, or that they might destroy evidence or clues important for these proceedings.  

The motion for custody has been forwarded to the Court of BiH, and the Prosecutor’s Office will resume its investigation in this case.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
