INDICTMENT ISSUED AGAINST JOSIP TOLIĆ (1967)

Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against Josip TOLIĆ, born on November 30, 1967 in Odžak where he permanently resides, a citizen of Bosnia and Herzegovina and the Republic of Croatia.

The  accused Josip TOLIĆ is charged to have, during the armed conflict in Bosnia and Herzegovina, as a member of the HVO and the 102 Odžak Brigade, while serving as a guard in the period from May to November 1992 in the municipality of Bosanski Brod and Odžak, acted contrary to the Geneva Convention Relative to the Protection of Civilian Persons in Time of War and participated both alone or together with other members of the HVO in the inhumane treatment of Serb civilians who were unlawfully incarcerated in the detention facilities: elementary school Odžak, elementary school in Novi Grad municipality, "Strolit" factory in Odžak and detention facilities in the building material warehouse in Bosanski Brod as well as premises of the  High School "Fric Pavlik" also in the municipality of Bosanski Brod.

In the twelve counts of the indictment, the accused is, inter alia, charged with unlawful incarceration to detention facilities, inhumane treatment of prisoners and abuse that resulted in the killings and death, participation in forcing illegally incarcerated female prisoners to sexual intercourse with  HVO members or other forms of sexual abuse of a mentally ill female prisoner.

Furthermore,  in addition to participation in the killings, torture, willful causing of serious physical and mental pain and suffering, the accused participated in taking prisoners to forced labor on the front lines, where several of them were killed and several injured, and has also participated in the looting of Serb prisoners.

The indictment was forwarded to the Court of BiH for confirmation.
