MOTION FOR REMAND IN CUSTODY FILED FOR TWO SUSPECTS
23.09.2013. 15:11The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor's Office of BiH filed a motion with the Court of BiH for remand in custody of the following suspects:
1. B.P.A. (1973) from Turin, Republic of Italy, a citizen of the Republic of Italy, and
2. A.G.E. (1980) from Turin - Republic of Italy, a citizen of the Dominican Republic.
On September 20, 2013 the Prosecutor's Office of BiH received a report on the crime committed, with evidence indicating grounded suspicion that the aforementioned suspects committed the criminal offense of Illicit Trafficking in Narcotic Drugs.
This case is the result of good cooperation and activities undertaken by the Sarajevo Canton Prosecutor's Office and the RS Special Prosecutor's Office, which have ultimately decided that this is a matter of international drug smuggling, which is under the jurisdiction of the Prosecutor's Office of BiH, hence the case was transferred to the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor's Office of BiH.
After the arrest the suspects were questioned in presence of a lawyer at the premises of the Special Prosecutor's Office in Banja Luka.
Prosecutor of the Prosecutor's Office of BiH filed a motion for remand in custody on grounds stipulated under Article 132, Paragraph 1, Subparagraph a) of the Criminal Procedure Code of BiH. Custody was requested due to risk of flight, especially due to the fact that if released the suspects could leave the territory of Bosnia and Herzegovina and would thus become unavailable for prosecution.
B.P.A. and A.G.E. are suspected to have become members of an international organized group of people who have, in the intent of acquiring unlawful benefits, together with other members of the group (known to them) transported the narcotic "Hashish" from Italy to BiH in the aim to sell it. On September 19, 2013 RS MoI officers found 4.896 grams of "hashish" hidden in the engine compartment during the search of the vehicle.
Motion for remand in custody was submitted to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
