JOINT STATEMENT OF THE HEADS OF 4 INSTITUTIONS ON INVESTIGATION IN BUDIMIR ET AL. CASE

In view of continuous media appearances of the President of the Federation of Bosnia and Herzegovina, Mr. Živko Budimir, pertaining to the alleged political reasons for his arrest and prosecution, and due to a series of other inaccurate allegations presented in the media with regards to the investigation and prosecution of Mr. Živko Budimir, the Prosecutor's Office of BiH and law enforcement agencies in Bosnia and Herzegovina (SIPA, OSA BiH and the Directorate for Coordination of Police Bodies) would like to inform the public of the actual facts and reiterate that the presented allegations are entirely inaccurate, and that all the actions and measures of the law enforcement agencies have been undertaken in compliance with the laws and Constitutions of Bosnia and Herzegovina and the Federation of Bosnia and Herzegovina.

The attacks on the Prosecutor’s Office of BiH and law enforcement agencies in Bosnia and Herzegovina - SIPA, OSA and the Directorate for Coordination of Police Bodies, lead by the President of the Federation of BiH, Mr. Živko Budimir, and the like-minded persons, represent the grounds for creation of legal insecurity. In this manner, law enforcement agencies, with the Prosecutor’s Office of BiH and the Court of BiH at the forefront, are hindered from doing their job in detection and prosecution of persons who committed criminal offenses regardless of the perpetrators’ status and position, all of which will eventually cause such a situation in the society where no one will be held responsible for the criminal offenses perpetrated.

Within his mandate, the President of the Federation of BiH, Mr. Živko Budimir, has approved the following:

-        Murder - 50 pardons;

-        Robbery and Aggravated Robbery – 22 pardons;

-        Abuse of Office or Official Authority – 10 pardons;

-        Criminal offenses against Traffic Safety – 21 pardons.

We would also like to point to the fact that millions of tax payer’s marks and all the efforts that Prosecutor’s Offices, Courts and law enforcement agencies in Bosnia and Herzegovina invested in investigating, proving, arresting and prosecuting the perpetrators of the gravest criminal offenses (murders, organized crime, smuggling of drugs and persons, etc.), have been quashed by an act of pardoning, and the entire work of all the law enforcement agencies, Prosecutor’s Offices and Courts has thus been annulled, which has caused the most severe blow to justice and rule of law.

In this way, conditions are being created for the very same criminals to be given amnesty from liability and freedom so that they can continue creating insecurity among the citizens of Bosnia and Herzegovina.  

We will persevere in our fight against corruption and in our efforts to establish the rule of law and protect the State of BiH and its citizens.
