CUSTODY MOTION FOR TWO PERSONS AND A MOTION FOR IMPOSURE OF PROHIBITING MEASURES ON ONE PERSON FILED
12.04.2013. 15:05The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption and within the Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the following persons in custody:
- T.V. (1977) from Sarajevo, BiH citizen, and
- M.M. (1975) from Bijeljina, BiH citizen.
The abovementioned persons were apprehended in the morning hours of April 10, 2013 by police officers and were handed over to the Prosecutor's Office of BiH, where they were examined as suspects by the Assigned Prosecutor.
Remand in custody for the accused is requested on grounds specified in Article 132, Paragraph 1, Subparagraphs a), b) and c) of the CPC BiH. Custody was , inter alia, requested due to risk of flight; the risk that, if released, the suspects might interfere with the investigation, suppress evidence and to seek to influence witnesses or accomplices, as well as that they might repeat the criminal offenses they are charged with.
After questioning, the suspect B.S. (1978) the Assigned Prosecutor decided to file a motion to the Court of Bosnia and Herzegovina to impose the measure of house arrest and travel ban pursuant to Article 126 in conjunction with Article 126d, Paragraph 2 of the CPC BiH, as well as measures to report periodically to designated state authority under Article 126 of the CPC BiH (reporting to the relevant police station once a week).
The Prosecutor's Office of BiH and Law Enforcement Agencies continue their activities and investigations in this case in the aim of indicting the suspects.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
