MOTION FOR REMAND IN CUSTODY AND IMPOSURE OF PROHIBITING MEASURES FILED
11.04.2013. 15:06The suspects, for whom the Assigned Prosecutor requested custody, were arrested by police officers of the Una - Sana Canton - Bihać.
During the search a certain quantity of counterfeit banknotes in denomination of 50,00 BAM was found and seized and the banknotes that were put into circulation are still to be traced.
After questioning the suspects, the Assigned Prosecutor filed a motion to the Court of BiH to remand in custody for a period of 30 days the suspects E.M. (1991) and P.R. (1992) on grounds specified in Article 132 Paragraph 1 subparagraphs b) and c) of the CPC BiH.
Custody was, inter alia, requested due to the danger that suspects could suppress evidence, influence witnesses or accomplices in order to prevent collection of evidence and the investigation and due to grounded suspicion that the suspect, if released, could repeat the same or commit a similar offense.
In relation to the suspects P.A. (1992), N. S. (1994), H. N. (1986), D. R. (1986) and A.S. (1978), the Assigned Prosecutor proposed that prohibitive measures be imposed under article 126 of the CPC BiH (ban on travel abroad, ban on issuance of travel documents of Bosnia and Herzegovina, prohibition to use the identity card for crossing the state border), as well as prohibiting measures of periodically reporting to the designated state authority under Article 126 (ban on meeting with other suspects in the case and report to the relevant police station).
The Prosecutor's Office of BiH and Law Enforcement Agencies will continue their activities to investigate this matter aiming to indict the suspects.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
