THE ACCUSED SILVIO BAGARIĆ (1969) CONCLUDED A PLEA AGREEMENT

The accused Silvio BAGARIĆ concluded an Agreement on Admission of Guilt for the committed criminal offense of Organized Crime under Article 250, Paragraph 1 in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The accused Silvio BAGARIĆ, born on September 30, 1969 in Zenica, residing in Busovača, citizen of BiH and the Republic of Croatia entered into plea agreement with the Prosecutor of the Special Department for Organized Crime, Economic Crimes and Corruption within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused BAGARIĆ fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH issued on March 22, 2012 that was confirmed in its entirety by the Preliminary Hearing Judge of the Court of BiH on March 28, 2012.

Prosecutor and the Defense agree that pursuant to the agreement the accused Silvijo BAGARIĆ be rendered an imprisonment sentence of 2 (two) years by the Court of BiH, as well as that the time spent in custody be counted as time served.

The proposed sentence is in line with the role of the accused in commission of the criminal offense.

The accused is charged with illicit smuggling of narcotic drug Marijuana (Skunk) from BiH to Republic of Croatia, committed during 2011.

With this agreement the accused person confirms that he is aware of the content of the indictment issued by the BiH Prosecutor's Office. He also confirms that the plea statement was given voluntarily, knowingly, with full understanding and undertakes to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial and appeal to the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.
