INDICTMENT ISSUED AGAINST V. D. (1977) FOR ILLICIT TRAFFICKING IN NARCOTIC DRUGS
15.03.2013. 15:45The accused V.D. is charged that during November and December 2011 he organized a group of people, with other persons from Montenegro that were known to him, for the purpose of acquiring illegal benefits through international sale, transfer and transport of Marijuana from the Republic of Montenegro to Bosnia and Herzegovina. The drug in question - Marijuana was declared a narcotic drug and its traffic prohibited under the provisions of the Law on Production and Distribution of Narcotic Drugs (Official Gazette of RBiH No. 2/92, 13/94) and Article 53 of the Law on Prevention and Suppression of Abuse of Narcotic Drugs ("Official Gazette of BiH" no.8/06.)
The indictment alleges that on December 14, 2011 he obtained, from a person known to him in the Republic of Montenegro, an undetermined amount of Marijuana, which he planned to move across the state border and that he hid in a deserted house. Members of the Police of the Republic of Montenegro have, while performing official duty, on December 25, 2011 found the drug with a total net weight of 25.565 kilograms.
The indictment charges the accused to have organized a group of people, who were engaged in international sale and purchase with the intent to sell, transfer and transport Marijuana, a substance which was declared a narcotic drug by regulation, for the purpose of acquiring illegal benefits, thereby committing the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 in conjunction with Paragraph 1 of the Criminal Code of BiH.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
