CUSTODY MOTION FILED FOR ZORAN MILIĆ (1962)

27.02.2013. 15:41
The Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the suspect Zoran MILIĆ (1962) into custody on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a), b) and d) of the CPC BiH.

The Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH filed a motion for remand in custody with the Court of BiH for the suspect Zoran MILIĆ, born on April 28, 1962 in Solakovići in Busovača, where he resides, a citizen of Bosnia and Herzegovina and the Republic of Croatia.

Zoran MILIĆ is under investigation by the Prosecutor's Office and is suspected to have, during the armed conflict between the Army of BiH and HVO, as a member of an HVO unit from Busovača acted contrary to the provisions of the Geneva Conventions Relative to the Protection of Civilian Persons in Times of War. He is specifically suspected of involvement in the killing of four Bosniaks, committed in Busovača in 1993 and of causing bodily harm and unlawful and wanton destruction of property.

Zoran MILIĆ is charged with the criminal offense of War Crimes against Civilians under Article 173, Paragraph 1, Subparagraphs c) and f), all in conjunction with Article 180, Paragraph 1of the Criminal Code of BiH.

The prosecutor requested custody due to belief that there are circumstances that indicate a risk of flight, and a risk that, if released the suspect might interfere with the investigation and influence witnesses or accomplices, as well as due to the fact that the suspect is under investigation for a criminal offence that caused extremely serious consequences hence his release could cause public order disturbances and distress citizens.

The Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the suspect into custody for a period of 30 days on grounds listed above.

The Court of BiH shall decide on the custody motion.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
