THE ACCUSED ALIJA HASANOVIĆ (1974) CONCLUDED A PLEA AGREEMENT

The accused Alija HASANOVIĆ concluded an Agreement on admission of guilt for the committed criminal offense of Failure to Pay Taxes under Article 211 of the Criminal Code of BiH.

The accused Alija HASANOVIĆ - born on April 30, 1974 in Sarajevo where he resides, with prior convictions, BiH citizen - entered into a plea agreement with the Prosecutor of Department III within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH issued on November 29, 2012 and confirmed by the Court of BiH on February 21, 2013.

Pursuant to the Agreement the Prosecutor and the Defense agree that the accused Alija HASANOVIĆ be rendered an imprisonment sentence in duration of one (2) years by the Court of BiH that shall not be executed providing that he does not commit another criminal offence within a three (3) year period following the final verdict.

The Prosecutor also agrees that, pursuant to provisions of Articles 110, 60 and 63 of the Criminal Code of BiH 104.488,40 BAM be forfeited from him as property gain acquired through commission of a criminal offense, which is the amount the accused should recover within a one (1) year period.

The indictment charges HASANOVIĆ with having, as an owner and a responsible person of a company, failed to pay taxes  from 2006 to 2007 thus causing damage to the budget in the same amount, which he shall have to recover to the State pursuant to the Agreement.

The proposed sentence is in line with the role of the accused in commission of the criminal offense.

With this agreement the accused confirms that he is aware of the content of the indictment issued by the BiH Prosecutor's Office. He also confirms that the plea statement was given voluntarily, knowingly, with full understanding and undertakes to reimburse the costs of the criminal proceedings that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial and appeal to the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.
