CUSTODY MOTION FILED FOR A PERSON SUSPECTED OF SMUGGLING A MAJOR QUANTITY OF NARCOTIC DRUGS
25.02.2013. 15:01The suspect Elsan HASANOVIĆ (1981) from Bijelo Polje - Montenegro, was deprived of liberty on February 20, 2013 at 7:30 p.m. in Vogosća by authorized officers of the State Investigation and Protection Agency (SIPA).
Custody was requested on grounds stipulated in Article 132, Paragraph 1, Subparagraph a) of the CPC BiH, because the suspect Elsan Hasanović is a citizen of the Republic of Montenegro, who has been given a decision of the BiH Service for Foreigners’ Affairs banning his entry to Bosnia and Herzegovina until September 12, 2013. The measure in question was imposed for a period of five years, hence there is a danger that if released he would leave BiH and thus render himself inaccessible to the judicial authorities of Bosnia and Herzegovina.
The aforementioned person is under investigation by the Prosecutor's Office of BiH and is suspected of committing the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the Criminal Code of BiH.
Custody motion was filed with the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
