CUSTODY MOTION FILED FOR FIVE SUSPECTS IN A JOINT POLICE OPERATION CODENAMED "TREBEVIĆ"

29.01.2013. 15:27
The Prosecutor of the Special Department for Organized Crime, Economic Crimes and Corruption within the Prosecutor's Office of BiH filed a motion to the Court of BiH TO remand five suspects, who are under investigation focusing on the detection and criminal prosecution of persons suspected of the criminal offense of Organized Crime under Article 250, in conjunction with the criminal offense of Customs Fraud under Article 216 of the Criminal Code of BiH and criminal offenses of Aggravated Theft under Article 287, Extortion under Article 295 and Aggravated Robbery under Article 289 of the Criminal Code of the Federation BiH, into custody.

The suspects whose remand in custody the assigned prosecutor requested were deprived of liberty on January 27, 2013 in a joint police operation codenamed "Trebevic", which included dozens of police officers and law enforcement agency officials from both state and entity levels.

Following the questioning of the suspects, the Assigned Prosecutor filed a motion to the Court of BiH to remand the following persons into custody for a period of 30 days:

-S.P. (1983), V.D. (1980), K.N. (1964) and B.M. (1980) from Sarajevo, and Č. M. (1966) from Grude.

The prosecutor requested custody on grounds stipulated in Article 132, Paragraph 1, Subparagraphs b) and c) of the CPC BiH.

Custody was, inter alia, requested due to risk that the suspects could suppress evidence and influence witnesses or accomplices in order to prevent collection of evidence and hinder the investigation, as well as due to reasonable doubt that the suspects, if released, could repeat the criminal offense or commit a similar criminal offense.

Custody motion was submitted to the Court of BiH and the Prosecutor's Office continues its investigation in the matter aiming to proceed with the indictment.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
