The accused Marinić is released pending trial and the Court of BiH Issued a decision on October 4, 2012 imposing prohibitive measures pursuant to Articles 123, 126a), 126b) and 126c) of the CPC BiH.

The case concerning Zoran Marinić belongs to the so-called "Category II" cases because it was transferred to the Prosecutor's Office of BiH from the ICTY Office of the Prosecutor.

The accused Zoran Marinić is charged that, during the war in Bosnia and Herzegovina and armed conflict between the Army of RBiH and the HVO, as a member of the HVO, he acted contrary to the provisions of the Geneva Convention of August 12, 1949 relative to the Protection of Civilian Persons in Time of War and the Treatment of Prisoners of War.

Zoran Marinić is, inter alia, charged to have on the night of April 26, 1993 in Busovača - Central Bosnia, along with several unknown HVO soldiers, fired weapons and used a knife while participating in the murders and wounding of four Bosniak civilians during an attack on their homes.

In this attack a disabled eighty-five-year-old man was killed as well as one middle-aged man. As a result of injuries sustained in the attack a sixteen-year old boy died a few hours later as well as one young girl two days later.

During this attack on Bosniak civilians, Zoran Marinić participated in the burning of their homes.

The accused Zoran Marinić is charged with the criminal offense of War Crime against Civilians under Article 173, Paragraph 1, Subparagraphs c) and f) of the Criminal Code of BiH.

The indictment was forwarded to the Court of BiH for confirmation.
