INDICTMENT ISSUED AGAINST MIRO BARNJAK (1969)
21.11.2012. 15:51Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against Miro BARNJAK, born on August 26, 1969 in the municipality of Gornji Vakuf, residing in Mostar, a citizen of Bosnia and Herzegovina and the Republic of Croatia.
The accused is charged with having, as a responsible person in the legal entity "PORTA" a film and theater production company based in Mostar, acted contrary to the legal provisions during the period from February 2006 to February 2007 since he did not pay the accrued amounts of value added tax (VAT) as reported in the monthly VAT returns for the period in question within the deadline prescribed by law.
The accused Miro BARNJAK is charged to have in this way reduced his tax liabilities for the total amount of 60,274.20 BAM thus causing damage to BiH budget for the same amount.
The accused is charged with evading payment of obligations required under the legislation of Bosnia and Herzegovina, by giving false information about the facts that are important for determining the amount of such obligations, and as the obligation evaded exceeds the amount of 50.000,00 BAM, he thereby committed the criminal offense of Failure to Pay Taxes under Article 211 of the Criminal Code of BiH.
The indictment was forwarded to the Court of BiH for confirmation.
